Terms and Conditions

To keep every booking seamless and expectations clear, please review the following terms and conditions before confirming your session with Punctual Lens Imagery®

1. THE RETAINER (Booking Confirmation)

A booking is only confirmed once the 50% non-refundable retainer has been received and cleared. Until payment is confirmed, the requested shoot date and time shall remain available to other clients and bookings.

Refund Status: The retainer secures our time, availability, scheduling commitment, and pre-production planning for the booking. As we may decline other work for the reserved period, the retainer is non-refundable under all circumstances, including client cancellation or rescheduling.

2. FINAL BALANCE SETTLEMENT

The remaining balance is due within 24 hours of the scheduled shoot end time unless otherwise agreed in writing. Deliverables, including edited images and final files, will only be released once full payment has been received and cleared.

Late Payments: If the outstanding balance is not paid within 48 hours after the session or event, the photographer reserves the right to suspend all editing, post-production, and delivery services until payment has been made in full. Continued non-payment may result in cancellation of delivery obligations

3. DELIVERY TIMEFRAMES

Punctual Lens Imagery aims to deliver all professionally edited images within the following estimated turnaround periods, commencing once the client’s final image selections have been received where applicable:

Standard Sessions: Final edited images will typically be delivered within 5 calendar days after image selections have been submitted.

Weddings & Extended Event Coverage: Final edited images will typically be delivered within 14 calendar days of the event date or final selection submission where applicable.

Expedited Delivery: Faster turnaround requests may be accommodated subject to availability and may incur an additional rush delivery fee.

Delivery timeframes are estimates and may vary during peak booking periods, public holidays, or due to circumstances beyond reasonable control. Clients will be notified promptly in the event of any significant delay.

All deliverables will only be released once the outstanding balance has been paid in full and cleared.

4. BOOKING CANCELLATION & RESCHEDULING

Client Cancellation: If the client cancels the booking for any reason, the booking retainer shall remain non-refundable and non-transferable.

Rescheduling: Clients may reschedule their booking once at no additional cost, provided a minimum of 7 days’ written notice is given before the scheduled shoot date.

Reschedule requests made with less than 7 days’ notice may incur a £50 rescheduling fee, payable prior to confirmation of the new session date. All rescheduled sessions remain subject to photographer availability.

Photographer Cancellation: In the unlikely event that Punctual Lens Imagery is unable to fulfil the booking due to illness, emergency, or circumstances beyond reasonable control, the client shall be offered either a priority rescheduled session at the earliest mutually available date or a full refund of all monies paid.

5. TIMING & PUNCTUALITY

Session times are scheduled and fixed in advance. Clients arriving late acknowledge that the session will still conclude at the originally agreed end time unless an extension is approved by the photographer and scheduling permits.

No refunds, discounts, or complimentary extensions will be provided for reduced shooting time resulting from client lateness.

Failure to attend the session without prior notice shall be treated as a no-show, resulting in forfeiture of all payments made and cancellation of the booking without refund

6. ARTISTIC DISCRETION 

By booking Punctual Lens Imagery, the client acknowledges familiarity with the photographer’s portfolio, editing approach, colour grading, and overall artistic style.

The photographer retains full creative discretion regarding image composition, editing techniques, retouching decisions, colour treatment, and final image selection delivered to the client.

As photography is an artistic service, refunds or compensation shall not be provided based on subjective aesthetic preferences where the delivered work is consistent with the quality, style, and creative standard represented within the Punctual Lens Imagery portfolio.

7. RAW FILES & UNEDITED FILES

Punctual Lens Imagery delivers completed and professionally edited work as part of its creative process and brand standards. Unedited RAW files, unprocessed images, and original camera files are not included in any package and will not be supplied to clients.

RAW files are considered unfinished production materials and do not represent the final quality, artistic direction, or editing standard of the brand.

8. INTELLECTUAL PROPERTY & IMAGE USAGE

Copyright Ownership: All photographs, edited images, and creative works produced by Punctual Lens Imagery remain the exclusive intellectual property and copyright of the photographer unless otherwise agreed in writing.

Client Usage Licence: Clients are granted a non-transferable licence to use delivered images for personal use only unless commercial usage rights are expressly included within the selected package or agreed upon separately in writing.

Permitted personal use includes social media sharing, personal printing, and non-commercial distribution. Images may not be sold, sublicensed, altered, heavily edited, filtered, or used for commercial advertising purposes without prior written consent from the photographer.

Commercial Usage: Where commercial usage rights are included, such usage shall be limited to the scope, duration, and purpose agreed within the booking package or licensing agreement. Copyright ownership remains with the photographer at all times.

Portfolio & Marketing Usage: Punctual Lens Imagery reserves the right to use images from the session for portfolio display, website content, social media, competitions, publications, promotional materials, and other marketing purposes unless a signed Non-Disclosure Agreement (NDA) or written confidentiality agreement has been agreed upon prior to the shoot date.

9. LOCATION PERMITS & ACCESS

The client is solely responsible for obtaining and paying for any required permits, permissions, licences, entry fees, or location access approvals associated with the chosen shoot location unless otherwise agreed in writing.

Punctual Lens Imagery shall not be held liable for any disruption, delay, restriction, or cancellation of the shoot resulting from the client’s failure to secure the necessary authorisations or access permissions.

Where a shoot is interrupted, shortened, or cancelled due to permit or access issues beyond the photographer’s control, no refund or reshoot obligation shall apply.

10. EMERGENCIES & LIMITATION OF LIABILITY

In the unlikely event of severe illness, injury, emergency, equipment malfunction, technical failure, data corruption, loss of digital files, or any circumstance beyond the reasonable control of Punctual Lens Imagery that prevents the delivery of contracted images, the photographer’s sole and maximum liability shall be limited to a full refund of all monies paid by the client.

Punctual Lens Imagery shall not be liable for any indirect, consequential, incidental, or commercial damages, including loss of income, loss of opportunity, reputational harm, or emotional distress arising from the inability to deliver images.

11. PROFESSIONAL CONDUCT

Punctual Lens Imagery maintains a zero-tolerance policy towards abusive, threatening, discriminatory, intimidating, or harassing behaviour directed at the photographer, assistants, crew members, or any associated personnel.

The photographer reserves the right to immediately terminate the session without refund if any behaviour is deemed unsafe, inappropriate, hostile, or unreasonably disruptive to the working environment.

In such circumstances, all payments made shall remain non-refundable, and any outstanding balances owed under the agreement shall remain payable.

12. TERMS AMENDMENTS & UPDATES

Punctual Lens Imagery reserves the right to amend, update, or modify these Terms and Conditions at any time without prior notice. The version in effect at the time of booking shall apply to the client’s agreement unless otherwise confirmed in writing.

13. AGREEMENT:

By paying the booking retainer, signing the agreement, or otherwise confirming the booking⧉, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

To Execute the Contract: We use your contact details to schedule shoots and deliver galleries.

To Create the Art: We process your Visual Data (images) through editing software to produce the final deliverables.

To Fulfil Orders: We share specific data with trusted third-party labs (for prints) or cloud providers (for gallery delivery).

3. THE “AI” CLAUSE (Artificial Intelligence)

We value the integrity of human identity.

Punctual Lens Imagery® does not knowingly license, sell, or upload your biometric data (photographs) to public AI datasets for the purpose of training generative models. Your face remains your own.

4. COOKIES & ANALYTICS

Privacy-First Analytics: We use privacy-focused analytics tools (such as Independent Analytics) that do not track your IP address or install invasive cookies on your device. We measure site performance without compromising your anonymity.

Functional Cookies: Essential cookies may be used solely for the operation of the booking system or payment gateway.

5. CLIENT REVIEWS & TESTIMONIALS
When submitting a review through our website or other digital platforms, you remain in control of how your feedback is used.

• Promotional Consent: Reviews will only be used for public marketing or promotional purposes where you have expressly provided consent by selecting the relevant checkbox on the review form.

Publicly Displayed Information: Where promotional consent is provided, the only information that may be displayed publicly is your review and a photograph from your session with Punctual Lens Imagery.

Personal Information: We will never publish your email address, telephone number, billing information, payment details, or any other personal data alongside your review.

Internal Feedback: Where promotional consent is not provided, your review will be retained for internal quality assurance, service improvement, and client experience monitoring purposes only and will not be published publicly.

6. DATA SHARING & THIRD PARTIES

We operate a strict “Need-to-Know” policy. We do not sell your data. Your information is shared only with:

Cloud Storage Providers: To host your secure password-protected gallery.

Professional Printing Labs: Only if you order physical products (Address/Image data only).

Payment Processors: To securely handle transactions (we do not store credit card details).

7. DATA RETENTION

RAW Files: Unedited files are retained for a limited period of 12 months for backup purposes before deletion.

Final Edits: Delivered JPEGs are archived for up to 2 years to facilitate re-download requests, after which they may be purged to ensure data hygiene.

Under applicable UK data protection laws, including the UK GDPR and the Data Protection Act 2018, you have the following rights regarding your personal information:

Right of Access: You may request a copy of the personal data we hold about you, including contact information, booking records, correspondence, invoices, contracts, and payment-related information. This right applies to your personal data and does not extend to unedited photographs, RAW files, rejected images, unprocessed camera data, editing project files, or other creative production materials, which remain subject to the terms of your service agreement.

Right to Rectification: You may request that inaccurate or incomplete personal information be corrected.

Right to Erasure: You may request the deletion of your personal data where applicable. Please note that we may be required to retain certain records for legal, regulatory, accounting, or contractual purposes.

Right to Restrict Processing: You may request that we limit the way we process your personal data in certain circumstances.

Right to Object: You may object to the processing of your personal data where processing is based on our legitimate interests.

Right to Withdraw Consent: Where processing is based on your consent, such as marketing communications, you may withdraw that consent at any time.
